Missouri lawmakers are taking a closer look at a serious problem in family courts: parental alienation.

Missouri House Bill 2308 (HB 2308), introduced by Representative Holly Jones for the 2026 legislative session, aims to protect the relationship between parents and their children when court ordered parenting time is denied. Supporters say the bill creates a clear path for accountability when one parent interferes with custody orders.

At the core of the bill is a simple idea: if parenting time is wrongfully taken away, it should be restored quickly.

HB 2308 focuses on several key issues:

• Addressing alienating behavior such as gatekeeping, interference with custody, and false allegations that disrupt the parent child relationship.
• Accountability for misconduct in family court. Parents found responsible for alienating behavior could be required to pay legal fees and professional costs.
• Restoring lost time through a concept advocates call “Time Taken, Time Back.” The goal is to quickly return missed parenting time rather than letting it disappear in lengthy court processes.
• Strengthening enforcement of parenting orders so children maintain meaningful relationships with both parents.

Supporters argue that intentional parental alienation can cause serious emotional harm to children and permanently damage family bonds. They believe stronger enforcement of parenting time protects both parents’ rights and the well being of children.

Critics, however, say the issue remains controversial. Some worry that claims of alienation could be used improperly in custody disputes.

As states across the country debate how to handle parental alienation in family courts, Missouri’s HB 2308 could become part of a larger national conversation about parental rights, accountability, and protecting children from family conflict.
