The Scottish government, in all its woke enthusiasm, tried to redefine legal categories in the name of inclusion. It wanted public boards to increase “female representation”\u2014a noble enough goal\u2014by allowing biological males with gender recognition certificates to count as women.<\/p>\n\n\n\n

The Scottish courts upheld the government\u2019s interpretation. So these women took it all the way to the UK Supreme Court\u2014and won.<\/p>\n\n\n\n

That\u2019s the kind of bottom-up resistance libertarians can admire. Civil society doing what the state won\u2019t: defending individual rights based on reality, not ideology.<\/p>\n\n\n\n
